New Zealand introduces a bill banning under 16s from social media, with fines up to 10 percent of global revenue

New Zealand Prime Minister Christopher Luxon introduced legislation in Parliament this week that would ban children under 16 from having accounts on social media platforms, with companies facing fines of up to 10 percent of their global revenue for failing to comply. The bill specifically names platforms like Instagram, TikTok, Snapchat, and Facebook, and would require them to take reasonable steps to verify a user's age using existing account information, facial recognition technology, or digital identity documents.

Luxon framed the bill in blunt terms, saying the country cannot accept the harm being done to a generation of New Zealand children and citing a statistic that one in three children between 13 and 17 are now spending at least five hours a day on social media. He specifically pointed to family life, mental health, sleep, and education as areas he says are being negatively affected, language that closely echoes the justification Australia used when it passed the world's first version of this kind of law back in December.

New Zealand is explicitly following Australia's lead here, and the bill's own framing leans on that precedent directly, with Luxon citing early evidence from Australia suggesting minimum age requirements are already changing youth behavior there. Not everyone agrees that evidence is convincing though. Opposition politicians in New Zealand have pointed to critics of Australia's law who argue enforcement has been weak enough that most children remain on these platforms essentially unaffected by the ban, treating it more as a symbolic gesture than an actual behavioral shift.

The bill's path through Parliament isn't guaranteed either. One of Luxon's own coalition partners, New Zealand First, has already said it won't support the legislation, with party leader and foreign minister Winston Peters publicly describing it as a slippery slope for where this kind of regulation could eventually lead the country. The bill does carve out an exception for messaging, email, voice, and video calling services, meaning private one to one or group communication tools wouldn't fall under the same restrictions as public facing social platforms

Ten percent of global revenue is a genuinely serious penalty structure, not the kind of token fine that companies just budget for and shrug off. That number alone signals New Zealand actually wants compliance rather than just wanting to make a political statement

Does that mean we will get an influx of under 16s on old fashioned bulletin boards?

Curious what reasonable steps for age verification actually ends up meaning in enforcement practice once regulators start interpreting that language in real disputes. Vague standards like that tend to get tested and refined through actual enforcement cases rather than being fully clear from the statutory text alone

[Ross88]

Age verification through facial recognition technology is going to generate its own separate privacy controversy regardless of how anyone feels about the underlying age restriction itself. Scanning children's faces to keep them off a platform introduces a whole new category of data collection concern

[Dean95]

Winston Peters calling this a slippery slope is worth taking seriously as a critique even from people who broadly support the goal here. Age verification infrastructure built for one narrow purpose has a well documented tendency to expand into other uses over time once it exists, regardless of what the original bill's stated intent was.

That's not really an argument against protecting children specifically, it's a broader concern about infrastructure creep once verification systems get built and normalized at scale. Worth watching whether New Zealand includes any hard sunset clauses or usage restrictions in the final bill text to address that exact concern directly, rather than leaving it entirely to good faith enforcement down the line

Following Australia's playbook this directly makes sense strategically even setting aside the actual merits of the underlying policy, since Australia already absorbed the initial wave of legal challenges, technical implementation headaches, and industry pushback as the literal first mover in this space. New Zealand gets to learn from all of that groundwork essentially for free rather than having to solve every implementation problem completely from scratch.

That's a smart sequencing choice regardless of whether you personally think an under 16 social media ban is good policy or bad policy on the merits. Countries considering similar legislation, and there are apparently a growing number of them given the UK and France references in this same story, are increasingly able to watch and learn from whichever country moves first rather than each having to independently work through the same enforcement and technical challenges in isolation. That kind of policy diffusion tends to accelerate once one country demonstrates it's actually workable, even imperfectly. Australia's early results, however contested those results currently are, are effectively becoming the reference case study everyone else gets measured against

The messaging and video calling exemption is the detail that actually makes this bill more thoughtfully scoped than it might first appear. Banning kids from group chats and video calls with friends would have been a much harder sell and arguably targeted the wrong thing entirely, since those tools don't carry the same algorithmic feed and engagement optimization concerns that public social platforms do. Focusing specifically on the feed based, algorithmically driven platforms rather than communication tools broadly shows some real thought went into where the actual harm is believed to concentrate. Not every piece of regulation in this space has drawn that distinction as cleanly

[Mia_59]

Kids finding workarounds to age restrictions has been the story with basically every previous version of this kind of rule, going back well before social media even existed. VPNs, borrowed identification, older siblings' accounts, there's always some path around a purely technical barrier like this one. The real test isn't whether determined teenagers can circumvent it, it's whether it meaningfully raises friction for the much larger group who currently just don't bother trying

[Craig]

The five hours a day statistic Luxon cited is the number that actually stopped me for a second, since that's essentially a part time job's worth of daily screen time concentrated specifically on social platforms for a third of teenagers surveyed. Whatever position anyone takes on whether an outright ban is the right policy tool here, that underlying usage number by itself is a pretty striking snapshot of how thoroughly these platforms have embedded themselves into daily adolescent life. It's easy to get lost debating the specific mechanics of enforcement and age verification technology and lose sight of the actual scale of the usage pattern that's driving the political pressure for a bill like this in the first place. Numbers like that are probably doing more to move public opinion than any specific policy detail in the bill itself

[Poppy28]

The coalition partner pushback is genuinely interesting politically, since it suggests this isn't a simple partisan issue splitting cleanly along expected lines the way a lot of tech regulation debates tend to. Having actual disagreement within the governing coalition itself makes the bill's ultimate passage much less certain than a straightforward government proposal usually would be. Would be curious to see how the final vote count actually breaks down once it comes time to decide
