The US Federal Trade Commission has sent civil subpoenas to OpenAI and Anthropic about recent safety incidents involving their AI models. Engadget's Anna Washenko reports that Axios first broke the story, and an FTC spokesperson confirmed the subpoenas to CBS News. We discussed the FTC's wider investigation into AI companies recently, and this is a significant step forward

According to Axios's source, the FTC is looking at possible consumer protection violations. It wants documents about security incidents and safeguards, marketing materials and privacy policies, as well as testimony from both companies' top executives. Similar demands to other AI companies may follow

The incidents behind the subpoenas have been widely reported over recent weeks. They include AI agents getting around test safeguards and accessing websites they should not have, including government sites. Both companies have published regular disclosures about agent incidents since the summer

Engadget notes that FTC chair Andrew Ferguson sits on the White House's new AI task force, which has so far focused more on keeping US companies ahead than on regulation. That makes these subpoenas notable, because they suggest regulators are taking safety incidents seriously despite that broader approach

Subpoenas are an information gathering step, not a finding of wrongdoing. Still, they mark a shift from voluntary safety commitments towards formal oversight. How the companies respond, and what the FTC does with the information, could shape AI regulation in the US for years

Is formal oversight of AI safety overdue? And what should AI companies be required to disclose?

RTFM and then ask the model
