That environment is exactly why AI adoption has moved faster among small operators than the more cautious, top down rollout typical of larger enterprises. The U.S. Chamber of Commerce reports 87% of small businesses now agree AI has increased their efficiency, and a separate Intuit AI Impact Report covering more than 34,000 small and mid sized US businesses found 77% now use AI daily. Adoption is happening one subscription at a time, calls answered by AI, spreadsheets automated, decisions supported outside normal business hours, without any formal company rulebook or AI usage policy guiding how it actually gets used

That absence of policy is becoming a real gap rather than just an oversight, as external rules start catching up with informal adoption. The European Commission published new AI transparency guidance in July, with Article 50 obligations covering AI interactions, machine readable content marking and deepfake disclosure taking effect August 2, creating real exposure specifically for US small businesses serving EU customers, agencies, content creators and SaaS founders with any European reach, even though most domestic-only small businesses remain unaffected for now
